We have a great deal of patients with mental health issues. What can I disclose?

The US Department of Health and Human Services, Office of Civil Rights issued guidance in 2018 regarding with whom PHI for patients suffering with mental health issues can be shared. Health care providers can disclose to other health care providers any PHI dealing with mental health and the patient.. This includes prescriptions and monitoring of those prescriptions, treatment modalities, frequency of treatments and results of tests. The provider can provide a summary of diagnosis, treatment plan, signs and symptoms, prognosis and progress. An individual’s authorization is needed to disclose psychotherapy session notes.
